Not easy to implement.<\/p>\n\n<\/div>\r\n\t\t\t \r\n\t\t<\/div>\r\n\t\n\n\n<p><\/p>\n\n\n\n<p>As Trump is ready to take over the government, the Laken Riley Act is in the news for its strict H1B rules.<\/p>\n\n\n\n<p>We are tracking the amendments being added to the act by various senators to make it better or stricter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Chances of Passing?<\/h2>\n\n\n\n<p>The chances of passing this act are low in my opinion. There have been too many amendments requested by senators that it will be difficult to make everyone agree on them.<\/p>\n\n\n\n<p>Senators Bernie Sanders and Dick Durbin have added their own rules which try to give freedom from one hand and take it away from another.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">H1B specific rules<\/h2>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">1. H-1B Wages<\/h3>\n\n\n\n<p><strong>What\u2019s changing:<\/strong><br \/>Employers will now be required to pay H-1B workers the higher of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>median local wage<\/strong> for the position.<\/li>\n\n\n\n<li>The <strong>actual wage<\/strong> paid to similarly employed workers.<\/li>\n<\/ul>\n\n\n\n<p>This replaces the previous \u201cprevailing wage\u201d standard, which critics argue allowed employers to underpay H-1B workers compared to their American counterparts.<\/p>\n\n\n\n<p><br \/><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">2. Increased H-1B Petition Fees<\/h3>\n\n\n\n<p><strong>What\u2019s changing:<\/strong><br \/>The filing fee for an H-1B petition will increase from $1,500 to <strong>$3,000<\/strong>. <\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">3. Auto Revoke H1B &#8211; if Mass Layoffs of Other Workers<\/h3>\n\n\n\n<p><strong>What\u2019s changing:<\/strong><br \/>Employers hiring H-1B workers must certify they have not issued\u2014and do not plan to issue\u2014a <strong>mass layoff notice <\/strong>within 12 months of the hire. <\/p>\n\n\n\n<p>If a mass layoff occurs after hiring H-1B workers, their petition will automatically be revoked after 120 days unless the employer certifies that layoffs will not reduce overall staffing.<\/p>\n\n\n\r\n\t\t<div  class=\"block-c44a2d06-3a9d-47e1-9207-c664605f0a80 alert alert-primary\" role=\"alert\">\r\n\t\t\t\r\n\t\t\t<div>\n\n<p><strong>Example<\/strong><br \/>A financial services firm hires 10 H-1B data analysts but announces a mass layoff affecting 30% of its workforce six months later. <\/p>\n\n\n\n<p>Under the amendment, the firm must either prove the layoffs won\u2019t reduce staffing levels in the affected roles or see the H-1B visas expire after 120 days. <\/p>\n\n\n\n<p>This will increase pressure on the H1B employee and will add uncertainty to the already complex immigration process.<\/p>\n\n<\/div>\r\n\t\t\t \r\n\t\t<\/div>\r\n\t\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">4. 120-Day Grace Period for Job Loss<\/h3>\n\n\n\n<p><strong>What\u2019s changing:<\/strong><br \/>H-1B workers who lose their jobs will now have a <strong>120-day grace period<\/strong> to secure new employment. <\/p>\n\n\n\n<p>This <a href=\"https:\/\/www.am22tech.com\/wp-content\/uploads\/2018\/04\/h1b-60-day-grace-period-am22tech.webp\">H1B grace period is currently 60 days<\/a> which is too small given that H1B LCA filing itself takes 2 weeks.<\/p>\n\n\n\r\n\t\t<div  class=\"block-bc2c48b6-6644-4f63-9d16-6e50df388696 alert alert-primary\" role=\"alert\">\r\n\t\t\t\r\n\t\t\t<div>\n\n<p><strong>Example<\/strong><br \/>An H-1B worker in marketing loses their job in January. <\/p>\n\n\n\n<p>Previously, they had only 60 days to find a new employer willing to sponsor their visa\u2014a tight deadline that often led to workers leaving the U.S. <\/p>\n\n\n\n<p>With the extended 120-day period, the worker has additional time to secure a new job and avoid the stress of immediate departure or visa expiration.<\/p>\n\n<\/div>\r\n\t\t\t \r\n\t\t<\/div>\r\n\t\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">5. Visa Stamping Within the U.S.<\/h3>\n\n\n\n<p><strong>What\u2019s changing:<\/strong><br \/>H-1B visa holders and others in specific categories (E, H, L, O, P) will now be able to <strong>apply for visa stamping in their passport without leaving the U.S.<\/strong> <\/p>\n\n\n\n<p>This eliminates the need for international travel solely for visa renewal purposes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">FAQ<\/h2>\n\n\n\n<p>I will keep adding the FAQs and answers as I receive them on various channels.
