{"id":196112,"date":"2025-01-13T08:54:05","date_gmt":"2025-01-13T14:54:05","guid":{"rendered":"https:\/\/www.am22tech.com\/?post_type=usa_news&#038;p=196112"},"modified":"2025-01-13T08:54:49","modified_gmt":"2025-01-13T14:54:49","slug":"h4-h4-ead-premium-processing-ending","status":"publish","type":"usa_news","link":"https:\/\/www.am22tech.com\/usa\/news\/h4-h4-ead-premium-processing-ending\/","title":{"rendered":"H4 &amp; H4 EAD premium processing to end on 18 Jan 2025"},"content":{"rendered":"\n<p>Currently, H4 visa holders (spouses and dependents of H1B workers) benefit from <strong>premium processing<\/strong> if they file their application with the H1B application. <\/p>\n\n\n\n<p>This service allows the U.S. Citizenship and Immigration Services (USCIS) to process their forms (I-539 for status extension and I-765 for work permits) faster when combined with a premium-processed H1B I-129 petition (used by the worker to file Amendment, extension, or transfer).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Timeline<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Before Trump: <\/strong>H4 and H4 EAD were approved in the same 15-day premium timeline as a courtesy. Note that there was never a premium processing available for H4 and EAD individually.<\/li>\n\n\n\n<li><strong>Trump in 2019<\/strong>: USCIS added a new requirement of biometrics (fingerprints) for I-539 applications under the Trump administration. This detached H4 &amp; EAD from H1B as H4 biometric itself could take several months.<\/li>\n\n\n\n<li><strong>Edakunni settlement &#8211; Jan 2023<\/strong>: Due to complaints and legal action, a temporary lawsuit settlement agreement (known as the Edakunni settlement) allowed USCIS to speed up the H4 and H4-EAD processing again when filed together with a <a href=\"https:\/\/www.am22tech.com\/usa\/news\/uscis-h1b-h4-ead-together-court-settle\/\" target=\"_blank\" rel=\"noreferrer noopener\">premium H1B application in Jan 2023<\/a> for <strong><span style=\"text-decoration: underline;\">at least 2 years<\/span><\/strong>.<\/li>\n\n\n\n<li><strong>Agreement expires on January 18, 2025<\/strong>: Now that the agreement is expiring, USCIS has decided to not continue the H4 and EAD processing within the H1B 15-day processing time.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">USCIS &#8211; No H4 &amp; EAD in Premium Time<\/h2>\n\n\n\n<p><a href=\"https:\/\/x.com\/AttyStevenBrown\">Steven Brown<\/a>, the immigration law attorney from Reddy Neumann Brown law firm checked with USCIS about the extension of the agreement prospects. <\/p>\n\n\n\n<p>Steven was part of this lawsuit (Edakunni) that forced USCIS to agree to process H4 and H4 EAD with H1B premium as this was the norm before the Trump admin added biometrics for H4.<\/p>\n\n\n\n<figure class=\"wp-block-embed\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">We have received confirmation that USCIS will not extend the <a href=\"https:\/\/twitter.com\/hashtag\/Edakunni?src=hash&amp;ref_src=twsrc%5Etfw\">#Edakunni<\/a> settlement for <a href=\"https:\/\/twitter.com\/hashtag\/H4EAD?src=hash&amp;ref_src=twsrc%5Etfw\">#H4EAD<\/a> that is set to end mid-January. <br><br>While this settlement required them to go back to the pre-biometrics policy of concurrently adjudicating I-539s and I-765s when filed with an I-129, it\u2026 <a href=\"https:\/\/t.co\/z2ATAiTF8I\">pic.twitter.com\/z2ATAiTF8I<\/a><\/p>&mdash; Steven Brown (@AttyStevenBrown) <a href=\"https:\/\/twitter.com\/AttyStevenBrown\/status\/1877816845132329369?ref_src=twsrc%5Etfw\">January 10, 2025<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>USCIS mentioned that they do not intend to continue processing the H4 and EAD as a courtesy in the same 15-day premium processing of the H1B application.<\/p>\n\n\n\r\n\t\t<div  class=\"block-ab52a326-7463-47d7-a386-842c513aa81f alert alert-primary\" role=\"alert\">\r\n\t\t\t\r\n\t\t\t<div>\n\n<p><strong>Expected Changes After January 18, 2025:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Premium processing for H4 and EAD forms will likely end<\/strong>, even when filed with a premium I-129.<\/li>\n\n\n\n<li>Dependents could face <strong>longer processing times<\/strong> for status H4 extensions and EAD work permits, possibly up to <strong>10-15 months<\/strong>.<\/li>\n\n\n\n<li><strong>No guarantees on simultaneous approvals<\/strong>, meaning delays in work authorization, driver\u2019s license renewals, or lawful status evidence.<\/li>\n<\/ol>\n\n\n\n<p><strong>What you can do before 18 Jan 2025:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>File H4 &amp;
