There has been increased checking of electronic devices at USA airports by custom and border protection recently.

We have collected the information about your legal rights that US laws offer for you.

The immigration law may offer different rights and options when you are trying to enter the US at the port of entry based on your visa status:

  • US Citizen
  • Green card holder
  • Visa holder (like H1B skilled worker or dependents like H4)

Citizens and Green card holder have better protection since their entry to the US cannot be denied while visa holders can be deported if they do not agree to immigration officer’s request to check their phone or laptop.

How to protect yourself?

#1 Travel with clean phone

This helps remove the guesswork to find and delete the information that may be private or something that you do not want others to see of read.

#2 Remove Fingerprint and Face unlock

Remove these locks so that your phone cannot be unlocked without entering the password explicitly.

Also, set up a strong password which cannot be easily guessed.

#3 Turn off the phone before reaching Immigration

If you do not want to remove fingerprint or face unlocking of your phone, you can turn off the phone.

When the officer will try to switch on the phone, the system (IOS or Android) will force to enter the password to unlock.

This is a security feature available on all phones.

#4 Deny to share Phone password

You have the right to NOT share your phone password.

But, things may turn ugly as entry can be denied for visa holders if they do not allow their device search.

  • Citizens and Green card holder: Your entry cannot be denied simply because you did not allow your devices to be searched. But, your device can be confiscated and sent for forensic analysis.
  • Visa holders: Your entry to the US can be denied by the officer if they have a strong reason to believe that your device search is needed to find your motive behind entering the US.

#5 Delete all offline data; Move everything to cloud

Delete all data that’s stored on your phone locally or move it to cloud like Google drive or dropbox.

As per CBP policy, they cannot search the data stored remotely on a cloud server. They are allowed to read or search into data that is locally saved on your phone or laptop.

Type of Device Searches

There are two types of device searches that Customs and border protection can perform:

  1. Basic/Simple search – Simple reading of messages/emails stored on your phone locally.
    • Simple look through emails to find the real motive of entering the US.
    • H1B visa holders intention to work for approved employer
    • Finding B1/B2 visa holders motives to work in the US or just have vacation
  2. Advances/Secondary search – Detailed device forensic analysis.
    • A supervisor permissions and/or a warrant may be needed.
    • A strong suspicion or threat to national security may be cited.

US government has made it mandatory to carry a legal status proof with you all the time you step outside your home.

The law has always been there on paper but is now strictly enforced by Trump government.

Given the increasing scrutiny at airports and other public places by police, attorneys are recommending that you carry the proofs all the time with you.

These two type of documents are sufficient at this time:

  1. Legal Status proof
  2. Photo ID
    • Real ID OR
    • Driving License OR
    • State ID Or
    • Passport

FAQ

Should I carry proofs while walking in the park or mall?

We strongly recommend to keep the proofs all the time with you whenever you step out of your home.

There have been instances where someone was walking within their community in the early morning hours. When someone called the police, he was asked to prove his identity and legal status without a chance to visit home and show those documents.

While this may be a one-off incident, but, we cannot rule out widespread implementation.

Hence, it is better to be cautious and carry proofs with you.

The news of F1 visa cancellations is real.

To add salt to injury, their SEVIS (Student and Exchange Visitor Information System) terminations are also done behind the scenes.

Foreign students in the United States are facing deportation simply based on their social media, driving tickets and other minor legal offences, as reported by many Forbes and multiple attorneys.

Attorneys have also faced this kind of situation for the first time as they think government is interpreting the law narrowly and taking unprecedented actions on students.

We have collected the primary options available for students whose F-1 or M-1 visa has been cancelled.

Only Visa Cancelled

If only your visa stamp in passport has been cancelled and your SEVIS is intact and active, then you are safe.

Visa in passport is only required to enter the USA and not physically stay. So, if you are physically in the US, you can keep staying and attending your school/college.

Both Visa AND SEVIS Terminated

This is a serious issue and needs immediate attention as per prominent immigration attorneys.

Option 1: Leave USA and Re-Entry

This is the easiest option and is commonly called ‘Self-deport’ using the government’s official self deportation reporting app.

To return to the USA, you will then need to obtain a new I-20, pay the SEVIS fee and get a new F-1 visa stamp from US embassy.

If the consulate approves your visa, you will be able to return to the USA.

But, make no mistake, the chances of approval are near zero given that the same visa was cancelled while you were in the USA.

Option 2: Lawsuit

You can choose to stay in the US and fight it out in courts. Several known attorneys have argued in the favor of pushing back and going the litigation route.

This will involve paying fee to the litigation attorney with no guarantee that the case will be won.

But, you have good chances if the reason for termination is a simple driving ticket or something similar.

Attorneys believe that odds of winning are in student’s favor.

  1. Due Process not followed by government: The lack of notice or information regarding terminations should create strong procedural due process arguments that could be compelling to federal judges.
  2. Arbitrary Action: The pattern of terminations based on mere allegations or even after acquittals suggests arbitrary government action that courts may find troubling.
  3. Lack of Specific Foreign Policy Justification: The government’s failure to provide specific information about alleged “foreign policy concerns” weakens their position in litigation.
  4. University’s Class Action lawsuit: Given that a First Amendment lawsuit has already been filed by university labor unions, affected students should consider aligning their legal challenges with this existing framework.
  5. First Amendment Considerations: For students whose terminations may be connected to political expression or campus activism, there are emerging legal arguments about the protection of free speech rights for non-citizens that could strengthen their cases.

Ofcourse, there are substantial legal costs involved and may be upwards of $3000.

You can still be deported while your case is going on unless the judge explicitly blocks your removal from USA.

Trump administration has one more addition to legal visa holders headache by updating major USCIS forms to include social media account information.

I share the history and how it has affected the visa applications in the name of security checks since it made mandatory for DS-160 forms in 2019.

You will need to declare all your social media account IDs on some of the important USCIS forms.

If you intentionally hide any social media account and it is later found by government, it can be taken as misrepresentation.

USCIS may deny your application based on misrepresentation.

DS-160 Visa Applications

Legal visa holders have already shared all their social account to US embassy whenever they have applied for any type of US visa.

US embassy has used that information to make a decision for your visa application.

Since this social account screening has started at US Embassy in May 2019, there is a new type of admin processing that has witnessed a steep rise.

This processing is called DS-5535 and is a little different regular form 221g processing.

Through this you have to tell your 15 years of travel history including all countries that you have been to and all addresses where you have stayed.

And as soon as it is issued by the embassy, there is no timeline for processing.

Most processing takes anywhere from two months to 2 years or even 3 years. During this time, the US government checks whether you pose a threat to national security.

National Security Checks

This is the same National Security Check that USCIS forms is trying to evaluate by asking for your social media presence.

The decision to ask for person’s private social accounts was challenged in court in 2019 but the case was dismissed by judge in 2023. Hence, this social media account policy is still applicable for all type of USA visa application.

The America being a free speech country tag has become a little loose and a lot is going to change in the
next couple of years.

That is why I suggest, that you stay away from politics and religion related issues on social media.

In today’s time, any controversy can be created over any issue. Interpretation of any issue can be different.

It is only written in the rule that your application cannot be rejected on the basis of what is written on your
social media.

But can it be trusted?

Now that the Trump government has changed the birthright citizenship interpretation of the law, what is the guarantee that your social media posts will be interpreted according to your wish?

USCIS has started enforcing the Alien registration rule after Trump government has signed the Protecting the American People Against Invasion executive order.

Everyone is required to register officially on USCIS website.

I have explained Alien registration rule in this video here in simple language:

Am I already registered?

These are the people who have already registered. Check if you fall into any one of the category.

  • Green card holders or Lawful permanent residents.
  • Parole: People entered the USA using Advance parole or similar parole program even if the parole validity has expired.
  • Visa holders:
    • If you were issued Form I-94 or I-94W (paper or electronic at land border) at your last entry to USA. It does not matter if the period of admission has expired, you are still considered registered.
    • If you are currently physically present in the United States and were issued green card or any type of USA visas before you entered USA
  • Removal/Deportation: If you are under removal or deportation order, you are already registered
  • EAD holders: If you ever applied for EAD and it was approved, you are registered.
  • Green card applicants:
    • If you have ever filed forms I-485, I-687, I-691, I-698, I-700, and provided fingerprints (unless waived), even if the applications were denied
  • Aliens issued Border Crossing Cards.

Example:

H1B workers in the USA are already registered and fingerprinted at the time of visa application at US embassy.

Who is not registered?

Anyone who has not never applied for a USA visa stamp in passport and provided fingerprints (unless waived) is not registered.

Check if you are not registered:

  • People who crossed the border illegally
  • Canadian visitors who entered the United States at land ports of entry and were not issued evidence of registration

Age 14

Everyone 14 years of age or older should be registered irrespective of whether they legally entered the US or not.

Most visa holders below the age of 14 are not required to give fingerprints when they apply for USA visa at US embassy. Hence, they need to re-register again when they turn 14.

Parents and legal guardians of kids below the age of 14 are responsible to register their kids within 30 days of reaching 14th birthday.

Once registered and after fingerprinted, you will get evidence of registration.

This proof should be scanned and kept in phone at all times. A physical copy of this proof is also required to be with you at all the time.

Kids below the age of 18 need not carry this proof with them. They are waived from carrying it around.

How does registration work?

Step 1: Create a USCIS Online Account

To register, you must first create a USCIS online account.

Each person must have their own individual USCIS online account.

This includes child under the age of 14. Create your child’s individual USCIS online account on your child’s behalf and in their name.

Step 2: Submit Form G-325R

Fill out an electronic version of the Form G-325R, Biographic Information (Registration).

It must be filed online through a USCIS online account. It cannot be filed by mail or in person.

If you are trying to register your child, then, use your child’s own USCIS online account to fill this form.

Step 3: USCIS review of Form G-325R

USCIS will review the information you provided.

If you are already registered:

  • USCIS will notify you that you have already complied with the registration requirement.
  • In this case, USCIS will not schedule your biometric appointment.
  • No proof or evidence of registration will be sent either.

If registration is required:

  • USCIS will check if you are required to appear for a biometric services appointment.
  • If you are not required to appear for a biometric services appointment (for example, Canadian visitors and aliens under 14 years of age), USCIS will provide you with evidence of registration.

Step 4: Attend appointment for biometrics collection

USCIS will schedule a biometric appointment at one of their Application Support Centers (ASCs).

This notice will be sent separately at your home address after you have submitted the form online.

There is no fixed time period to receive this notice but it generally arrives in about 1-5 weeks.

No biometric services fee is required at this time under the Interim Final Rule.

If you do not attend your biometric services appointment (if required), you will be considered as unregistered person.

Step 5: Receive registration documentation

Once you have registered and provided your biometrics (if required), you will get a proof of registration in your USCIS online account.

Download this proof, print and keep it with you all the time if you are 18 years or older.

PENALTY

USCIS has made it a legal obligation.

Failure to register may result in criminal and civil penalties, up to and including misdemeanor prosecution, the imposition of fines, and incarceration.

In simple language:

  • $100 fine if you have registered but not carrying proof of registration
  • $5000 And/or up-to 6 month jail if you have not registered at all.

I am sure you do not want to pay the penalty and certainly do not want to see yourself in jail.

B1/B2 Visa Holders

Many people travel to the USA on tourism or business meetings using B1 or B2 visa.

There is no need to worry if you got your visa after you turned 14 years or more as you are already registered and fingerprinted by the US embassy.

If you are less than 14, and plan to stay in the US for more than 30 days, then two situation may arise:

  1. Entering USA after turning 14: Your fingerprints will be taken at port of entry.
  2. Entered USA before turning 14: You should register if your fingerprints were not taken at port of entry.

FAQ

Do we need to register our parents coming to US on tourist visa? They have been here before in past.

There is no need to register parents coming to the US for vacations.

Parents coming to the USA on tourist visa are already registered and fingerprinted automatically at the time of their entry at airport.

What should be filled in G-325R form Immigration Status at last arrival?

People who entered the USA using a valid visa or advance parole can leave it blank as there is no other valid applicable option available for them.

People whose i-94 has expired but their extension is pending can also leave it blank.

H4 kids who entered the US after turning 14 should be ten-printed at the port of entry. Do they also need to be registered on USCIS website?

Not required.

Since the child entered the USA after turning 14, he/she would have already been fingerprinted and automatically registered in government database.

What happens if we register if the person is already registered? Is there a penalty or fine by USCIS?

There is no penalty or fine or negative impact if you register for a person who is already registered.

This was shared by one of our member who was not sure if their child was registered or not with USCIS. Hence, they submitted the form online and received this status:

USCIS will not send any biometric (fingerprint) appointment notice if you are already registered in their system and they have fingerprints in their database.

I have registered online with USCIS. My fingerprinting is pending. Does it mean the process is done? Any other problem if travel to India with this status?

The important thing to understand is that there is no ‘status’ once you exit the US physically.

Whatever status you have like a visa status H1B. H4 etc. is applicable only till you are physically present in the US.

If your fingerprinting is pending, it is better to stay back in US until the fingerprints are completed.
If you cannot stay and have to leave, you can leave with no issues. Your exit information is automatically sent to government by airline (if you leave by air).

if your fingerprinting is done, you are good for current stay in the US.

If you leave US and return later, the registration needs to be done AGAIN as per the age and registration rules.

You can get a USA green card by investing money in a US-based business.

You can even start your own business and if you can create 10 jobs, you will be eligible for a green card.

You are allowed to buy an existing USA business and still be eligible for an EB5 green card.

EB5 Investment Rules

#1 Investment Amount

  • Rural Areas or targeted employment areas (Urban high unemployment): Investment of $800k required.
  • Urban Area: A $1+ million investment is required to be eligible for an EB5 Green card.

The Immigrant Petition by Alien Investor (Form I-526e) petition form is required to file your application.

#2 Priority Date Retention

If you have multiple approved EB5 petitions, then you can use the earliest priority date, which is the date on which the petition was properly filed.

Also, you cannot use your EB2 or EB3 PD date with the EB5 application. Basically, you cannot port your EB1/2/3 green card queue date to the EB5 application.

#3 Managerial Control / Money at Risk

Your investment for the EB5 Green card should be at risk, meaning that it is invested in a real business. No risk means that USCIS will reject your application.

#4 Full-time jobs for 10 workers

Your company should create 10+ full-time jobs in the USA for U.S. citizens, lawful permanent residents (Green card holders), or other immigrants lawfully authorized to be employed in the United States.

You can count the jobs for these people:

  • US citizen
  • Green card holder
  • Conditional resident (Conditional green card holder)
  • Temporary resident,
  • Asylee,
  • Refugee,
  • A person residing in the United States under suspension of deportation

You cannot count the jobs where these visa holders are working:

  • H1B
  • H4 EAD workers
  • L1/L2 visa workers
  • L2 EAD workers
  • F1 OPT workers

You cannot count yourself, your spouse or your family members to satisfy this 10-employee requirement.

New Business

There are strict rules for starting a new business or buying an existing one if you want to use it to file your EB5 Green card.

The business should be run for profit. Non-profit companies are not eligible for EB5 green cards.

This company can be run as:

  • A sole proprietorship
  • Partnership
  • Holding company and its wholly owned subsidiaries (provided that each subsidiary is engaged in a for-profit activity formed for the ongoing conduct of a lawful business);
  • Joint venture
  • Corporation
  • Business trust
  • Limited liability company (LLC)
  • Other business entities, which may be publicly or privately owned

FAQ

Can I open an IT consulting company and show H1B workers for 10 job creation?

You cannot count 10 jobs for EB5 if you hire H1B workers on all those 10 jobs.

You can certainly hire H1B or H4 EAD workers but you cannot count them for your EB5 green card application.

How Can I collect money for an EB5 business investment green card?

There are various ways to collect money for EB5 green card including using your savings, 401K (if you are working in the US), personal loan, car loan, home equity loan, etc.

Can I use my residence home which is worth $800K for EB5 investment?

No, you cannot use your personal residence to show as a business investment for the purpose of claiming an EB5 green card.

But, you can take a HELOC (home equity loan) on your residence and then invest it in an EB5 business. This is allowed.

What kind of investments have high approval rates?

Most of the EB5 businesses are in the real estate sector (almost 95% of them) as job creation is easy there.

Many people start their own direct business in rural areas like opening a 7-11 gas station, a subway franchise, or opening their restaurant.

You can open a McDonald’s franchise too but then the 10 job creation rule applies.
