Work in US using H1B. Return to US later when priority date is current. Can work remotely from Canada for short time.

The post Get Australia, Canada PR and Still Work on H1B Visa appeared first on AM22Tech.

]]>
Many people are filing either Australia or Canada PR to create a backup in case the US green card country-based limits are not removed. Most of these applicants are born in India and China.

They are stuck in extremely long employment-based backlogs due to the 7% limit on each country in US immigration law.

Can I work from Canada using my PR on an H1-B visa?

You can work from Canada using your PR and there is no H1B visa required.

H1B visa requires your physical presence on US soil to get into H-1B status.

H1B Stays Active?

If you are working in the US on an H1B visa, your US work authorization is not affected by your PR for any other country like Australia or Canada.

Once you are outside the USA, you are not actually using an H1-B visa at all as US immigration law does not apply to you.

If your US employer is ready to pay you a salary in Canada, while you work remotely, you can do it perfectly legally as per Canadian laws. You do not need an H1-B visa for this situation.

How to Keep H1B Active?

If you still want to hold on to your H1B job as your US employer does not have any Canadian or Australian operations, you will need to come back to the US.

Risks

  • You can work remotely from Canada or Australia for some amount of time but if you cross 180 days, the tax residency laws will come into play.
  • Your H1B extension might be denied if you keep working remotely from outside the US.
  • USCIS conducts site visits routinely and you may be in trouble if they do not find you working in the US at the location specified in your H1B petition.

i140 Approved, Migrate, Return in Future

Once your i140 has been approved in the US, you can safely migrate to Canada or Australia. You can even leave your US H1-B or L visa job.

If you want to return to the US in the future when your Green card priority date gets current, you can return to file an i485 adjustment of status application as long as you can find an employer to sponsor you in the US.

You have two options:

  • Join the same employer who holds your current i140 Or
  • Find a new sponsor and file a new PERM followed by i140 and i485 concurrently.

You can also file an H1B transfer anytime in the future with your approved i140 even if you are started living in Canada or Australia.

Return to the US on L1A Visa?

If you are currently working in the US using an H-1B or L1 blanket, then you might get eligible for an L1A visa if you can work in Australia or Canada for at least 365 days as a manager.

Australia, Canada PR Validity

Both Australia and Canada offer 5-year PR based on your skills. Their merit-based system favors highly skilled educated people and offers extra points for English language proficiency.

Once you get the PR, you get multiple entries and exit rights. You can also work in any job profile irrespective of what skill you used to get PR in the first place.

This is similar to the US green card.

PR Validate, Return to the US

I know many people who have got both Australian and Canadian PR but have still opted to hold on to their H1-B job in the USA.

They have just visited the PR country for initial validation and returned to the US.

Both Australia and Canada give you an initial entry date, which is printed on your PR. You have to enter the country at least once to activate the PR.

Once granted, it is considered valid for the next 5 years. You can migrate anytime in those 5 years.

Renew PR after 5 Years

Both Australia and Canada have residency conditions placed on their PR to motivate people to settle down in the country.

The PR renewal or extension is nothing but a ‘resident return visa‘ (RRV) that you should apply for if you want to enter Australia or Canada after the 5 year PR term ends.

Resident Return Visa Conditions

  • Spend two or more years in Australia in the last five years.
  • Spend two or more years in Canada in the last five years.

If you have spent less than two years, then you have to explain why immigration should issue you RRV since you have not made Australia or Canada your usual place of residence.

If your RRV is not approved and you are outside Australia or Canada, and your PR visa is also expired, then your PR status is gone as well.

Citizenship Criteria

You will have to live and work in Australia for at least 4 years before you can apply for citizenship.

Similarly, Canada wants you to stay there for at least 3 years in the last 5 years before you can apply for a passport.

Use TN, E3 Visa to Work in the USA

If you have migrated to either country, you can come back to work in the US using either E3 or TN visa if you do not want to use H1B.

  • The US has a special work visa for Canadians and is known as a TN visa.
  • Similarly, Australian passport holders can come to the US on E3 visas to work.

Note that TN and E3 visa does not allow ‘dual intent’ meaning that you should not aim to file a US green card application.

On the other hand, the H1B visa allows dual intent.

Hence, even if you migrate and want to return to the US later, you should use your H1B visa to come back to the US.

The Indian Embassy requires Annexure F for lost or damaged passport renewal and other Indian OCI services in the USA, Australia, Canada, the UK, and others.

In the Netherlands, the same Affidavit F is known as Annexure L.

This affidavit declares the details of how the passport was lost or damaged. The format of the affidavit varies a bit by the Indian embassy in the country where you are applying for a passport.

We have an app that you can use to create this Affidavit without worrying about the format. It automatically picks the correct format based on your country.

You will need to declare your last 3 addresses and the page numbers of the entry and exit stamps if you are an NRI (Non-resident Indian).

Annexure F/L Lost Damaged passport online

The app creates a pre-filled PDF file with all the required information for Annexure F. You can then upload it or send it with your passport renewal package.

Open App in new Window

What is TR Concession?

The TR concession on Annexure F means ‘transfer of residence’.

Transfer of Residence is an option to save Indian customs duty if you want to move to India after a stay abroad of at least two years. You can take most personal and household items without paying Indian customs duty with some exceptions.

The question on the Affidavit “Have you availed TR concession” can be answered as No if you have not used this transfer of residence option anytime in the past.

FT Allowance Meaning?

FT allowance on Annexure F means ‘Fund Transfer’ allowance.

Normally, when you travel abroad from India, you buy foreign currency for travel needs. This is usually mentioned on the last pages of your passport by the bank or the agent who gave you the money.

If something like this was mentioned on your passport, then please select ‘Yes’ and provide details.

FAQ

Is Annexure F mandatory for passport renewal?

Annexure F is required in case your most recent passport was lost or damaged.

Can I fill out Annexure F passport with a pen?

You can fill the Annexure F by handwriting it with a pen.

I am an NRI, where should I file the police report for a lost passport?

You should file a police report in the country of your residence for a lost passport.

Example:
If you live in the USA and your Indian passport was lost in France while you were on vacation, you will file the police report at France’s local police station.

Then, you will fill this Annexure F and apply for a new Passport with the Indian Embassy in France.

Is a police report required for a damaged passport?

No, the police report is not required for a damaged passport.

Is notarization required for Annexure F?

Notarization is required for Annexure F.

You can get it notarized from a local notary at the place of your residence.

For example, In Australia, the ‘justice of peace’ representative can notarize Annexure F.
Similarly, in the USA, the notary at bank, or mail offices like USPS/UPS or a local library can attest with their sign and stamp.

Can I travel with a water-damaged passport?

You may not be allowed to travel with water water-damaged passport.

A passport is considered damaged if its biometric pages which contain your photo, name, and passport barcode are damaged.

In most cases, the immigration of the destination country may not allow you to enter even if the Passport number, name, and photo are intact but pages of the passport are damaged beyond recognition.

We strongly advise you to get the passport reissued if you have any kind of small or significant damage irrespective of whether it is done by water or not to avoid travel issues.

How do I fill VFS Annexure F when It has no space for filling details?

The specimen provided by VFS does not have enough space to fill in the details on their ANeexure F sample.

We suggest using our app to fill Annexure F as it takes care of all the spacing and makes sure that you do not miss any required details.

Please note that the Indian embassy or VFS will reject your application if you miss any details on the Annexure F affidavit.

Is a photocopy of the lost passport required?

A photocopy of the old passport is not required in case of lost/damaged/stolen passport.
It should be shared if it is available though.

You should provide passport details like passport number, Date of issue, Date of expiry, and place of issue.
If you do not have that information, then contact the respective Indian embassy for information on how to get the new passport.

It is important to scan your passport and keep it in Google Drive or a similar cloud service for easy access.

The post One and Same Person Affidavit for Multiple Names (Immigration/Other) appeared first on AM22Tech.

]]>
Do you have a different name version on your passport, education degree, and other visa and legal documents?

If yes, then you can create a ‘One and Same Person Affidavit‘ and get it notarized to prove that all names belong to the same person.

This affidavit is also known as the ‘same name affidavit form’ and can be submitted for legal purposes such as immigration, Green card application, or PR for Australia, Canada, the UK, and other such countries.

You can either write this affidavit yourself or use an app to fill it out for you.

Affidavit for Multiple Names on Different Documents

Open App in new Window

#1 Enter your Details

Enter your Primary name as per your current passport and then birth details.

You are also required to enter your current residential address. This address can be anywhere in the world irrespective of your birthplace or home country.

#2 Enter Other Names

You can enter different versions of your name for yourself. This is the same as entering your alias name.

Make sure that you do not make any mistakes in the name spelling as they will be written on the affidavit PDF.

Should I consider Social media names as ‘Other Names’?

A lot of people get confused with respect to choosing which names are considered other names especially when we use different alias names on social media platforms like Facebook, Twitter, YouTube, and others.

The rules for what is considered ‘other names’ vary by country and purpose. We suggest writing all the names that you think people (your friend circle and family) know you along with your social media names.

Examples:

  • In the USA, it is expected and required by law that you consider all names like maiden name, social media names that people know you with, and names on all legal documents like passport, birth certificate, education documents, and others mentioned on this same name affidavit form.
  • Other countries may have different requirements and may or may not require you to mention your name that you are not on any legal document.

Our suggestion is to use all names if you are not sure about the actual requirement to make the document universally acceptable.

#3 Enter Father’s Name

The last step in data entry is to fill in your father’s name. Once you are done, you can click the ‘validate and save’ button to check all your data.

If there are any errors, the app will automatically ask you to fix them.

If there are no errors, you can purchase (if applicable) the document and your affidavit will be sent to your registered email address within minutes.

Email with Affidavit

Notary

The notary will be required from your local notary to make it a legally valid document. You must sign this affidavit in front of the notary.

The notary service may be known by a different name in your place of residence like ‘Justice of peace’ in Australia, ‘Commissioner of Oaths’ in England / Wales, etc.

There are options for online notaries as well in the USA where they connect and see you sign via video call. Not all states in the US accept online notaries though.

Example:

The state of Texas in the USA allows online notaries while some counties in California accept documents notarized by online communication.

Please check with your local state/county law before getting online notary services:

Photo on Multiple Name Affidavit

The photo is not required but highly recommended to avoid forging documents.

We recommend pasting a passport-size photo (according to the passport photo rules) of your country of residence and then signing across the photo so that half of the signature appears on the affidavit.

Sample Same Name Affidavit

This is a sample affidavit that arrives by email.

The app automatically adds the most recent tried and tested legal language based on your country and state of residence. All such country and state-specific formats have not been shown here due to limited space.

Example:

  • The same name affidavit in New York, US may have a slightly different language than the one created for a person living in Edinburg, UK.
  • Similarly, the language of the same name affidavit may be edited by the app based on the purpose of use like immigration or real estate purchase, or a civil/criminal court case proceeding.
  • The address on the final affidavit is also printed based on the residence address, and the address format requirements along with country-specific date formats.
  • The self-help app will always provide you with the most recent and updated PDF document that’s currently being accepted by your local government and the purpose.
  • The app provides LIVE text chat support in case you have questions and a full refund policy.

FAQ

Is a Notary Required for Multiple Name Affidavit?

The notary is required for multiple name Affidavits if you intend to use them for legal purposes in court or for applying for a visa/ immigration to Canada, the USA, Australia, or other countries.

Can I Create an Affidavit on Plain Paper?

You can write or print the Name confirmation Affidavit on plain white A4 size paper to claim all or both names are the same person.

This name mismatch declaration is enough to prove the difference in your name between your passport, education documents, and other national IDs.

Example:
The ‘One and the same person’ affidavit can be used by a person in Kerala, India, or someone in California, USA to be used for an Australian PR application or Canada permanent residency.

Can I use this Affidavit at multiple places?

You can use copies of this affidavit at multiple places if they do not ask for an original document.

If you submit the photocopies of this affidavit and the agency accepts it, you can keep using it.

Can I use this affidavit in Florida?

You can use this affidavit in Florida.

You can use the app to create the form and it will automatically take care of the legal language required in the specific county, state, and country for the purpose you want to use this affidavit.

I changed my last name after marriage. Is it considered another name?

The last name change after marriage is considered ‘other name’ and you should create a ‘multiple name affidavit’ to prove both names belong to the same person.

Some people add a middle name after marriage to add in-laws’ last name to their full name. This new name is also considered a name that people know you with. Hence, you should create this affidavit.

The maiden name (name before marriage) is also considered another name.

Can I use an affidavit for Driver’s license?

Yes, you can use this affidavit for driver’s license.

The government of India recently simplified the process and did not require OCI to be reissued for every Passport renewal or change in address.

OCI means the Overseas Citizen of India and allows visa-free travel for Indians who have got citizenship in other countries like the US, Canada, UK, Australia, and others.

Benefits of OCI:

  • Get you multiple entries, and a multi-purpose lifelong visa to visit India.
  • Allows exemption from reporting to local Indian Police authorities for any length of stay in India; and
  • Equality with NRIs in financial, economic, and educational fields except in the acquisition of agricultural or plantation properties.
  • OCI is also issued to kids of Indian citizens who do not hold Indian passports.

OCI Reissue is not Required

  1. Minor child up to 20 years – OCI renewal is not required for minor children on a change of
passport. Only upload the latest passport copy and photos on the OCI website.
  2. Adult OCI Issued after 20 years of age – OCI renewal is not required for any OCI issued after 20
    years of the applicant’s age.
  3. Adult Older than 50 years – OCI renewal is not required after 50 years. However, you should
upload latest passport and photos ONCE after completing 20 years using the below process.
  4. Change of address/contact details – Renewal of OCI is not required for change of address.
Upload the latest details using the below process.

Change of nationality – Any Age Yes Yes

OCI Reissue is Required

  • Change of nationality

If you are an existing OCI cardholder and require uploading the latest Passport copy and photo, please follow the following steps.

Since it takes 2 weeks to 4 weeks to update the system it is better to complete it ASAP.

Many people working in the USA are applying for Australia PR and are thinking of moving soon. The primary question that comes to mind is: Can I get an H1B visa stamping in Sydney or Melbourne with an Indian passport?

The answer is yes, you can apply for an H1B visa stamp with an Indian passport at any Australian US embassy including the visa stamp for H4 dependents visa in your family

Australia has US consulates in Sydney, Melbourne, Perth and Canberra.

You can apply for an H1B visa interview at any of the embassy closest to your location except Canberra. The U.S. Embassy in Canberra does not process visa applications.

Also, Immigrant visas like I-130 family sponsored applications are only processed by Sydney.

H1B Visa Stamp While Validating Australia PR

If you are going to Australia for PR validation, you can apply for an H1B visa for your return to the US.

If you are visiting Melbourne for tourism or family, you can get your H1B visa renewal and re-enter the US.

There is no explicit information about visa scheduling for third-country nationals on the US embassy website for Australia. So, we assume that there are no stringent residency requirements.

Many people on multiple immigration forums have reported earlier that they were able to get H1B, L works visa, or B1/B1 Visitor Visa easily.

Example:

Citizen of India currently in USA on an H1B visa has changed employer with approved H1B transfer. You can get a visa stamp on your visit to Australia using approved I797.

Chances of H1B approval in Australia?

The chances of H1B approval are the same as in India or Canada or Mexico. You may receive a form 221g if the embassy needs more information on your case.

You should plan for at least 3 weeks’ time to cater to any un-expected situation with admin processing.

H1B Interview Questions

You can expect the questions about your H1B job in the USA along with your education degree from the visa officer in the Australian US embassy.

  • You should be ready to answer if asked “Have you worked in the US before?“.
  • Another common question is: Have you received an H1B visa before for the employer you apply visa for?

Visa officer may ask the reason for your Australia visit as it is not common for Third-country nationals to apply for H1B there. If you are visiting to validate your Australia PR, you can clearly tell the same.

Australia 189 or 190 PR holders are expected to prove that they will go back to the US for work and not just stay in Australia and work remotely. If you intend to work while staying in Australia to maintain your PR, you do not need an H1B visa as per US immigration laws.

So, be careful about what you say there.

You are allowed to travel between Australia and the US if your majority of stay is in the US.

It is important that you carry your original marriage and childbirth certificates if H4 dependents are also with you.

US University Degree

The chances are very high for H1B approval without any form of 221g for people who have done their bachelor’s or Masters’s degree from US-based universities.

The general guidance from USCIS is that you should apply for an H1B visa stamp in your home country. US embassy in your home country has good knowledge about educational degrees and university status. This makes it easier for the visa officer to analyze and make an informed decision on your case.

Dropbox Eligibility

If you are eligible for H1B stamping in India using Dropbox, you may still have to appear for a visa interview if you opt for Australia.

In some cases, you are eligible for dropbox in Australia even when your last stamping was in India, Mexico, or Canada. You can check it using our app above.

Process

#1 Fill DS160 visa application form

Start with filling DS 160 online.

DS-160 now requires your social media account usernames like Facebook, Twitter IDs as per new requirements.

#2 Create an account on USATravelDocs website

The USATravelDocs Indian website is different than the Australian version.

  • If you are applying for a U.S. Visa in Australia for the first time, you have to create a new account.
  • It is possible that ‘usatraveldocs’ website does not let you choose Australia as the option if you have created your account on the Indian usatraveldocs website.

As shared by our guest Sachin in the comments earlier, he was able to contact both Indian and Australian usatraveldocs support and they explicitly move your details to the Australian website. This helps you to book an appointment in Australia.

Each USATravelDocs account is attached to a primary passport number. If the Indian USATravelDocs website has your own passport number, then you can use your wife’s passport number to create an ID on the Australian website.

#3 Pay Visa Fees

You have to pay visa fees for the type of visa you selected. You can pay by your US credit/debit card.

You should use a card that does not charge foreign transaction fees to save on extra charges. Discover and Synchrony bank credit cards (like Sams Club card) do not charge foreign transaction fees.

#4 Schedule Appointment

Click on Schedule Appointment on the left-hand side menu to schedule your appointment.

You will need:

  • Your passport number
  • Visa fees payment “Unique Sequence No” from Australia Post receipt or the “Receipt No” if you paid by credit card.
  • The ten (10) digit barcode number from your DS-160 confirmation page

#5 Attend visa interview.

Carry a printout of your appointment letter, DS-160 confirmation page, one recent photograph (2×2 inch), your current and all old passports, and the original visa fee payment receipt.

Use H1B visa stamping documents checklist to make sure nothing is missing.

#6 Passport Sent by Mail – Australian Address Required

US embassy in Australia has no option to drop off or collect the passport from the VFS location or embassy. Hence, you should have an Australian local address ready to receive your stamped passport.

UsaTravelDocs uses Toll courier for sending your passport.

US Embassy Jurisdictions

Sydney takes care of residents in the Australian Capital Territory, New South Wales (NSW), Norfolk Island, and Queensland.

US embassy in Melbourne has jurisdiction over the Northern Territory, South Australia, Tasmania, and Victoria.

Annexure E is required by the Indian Embassy for passport renewal and other Indian OCI services in the USA, Australia, Canada, the UK, and others.

Annexure E is simply an affidavit by an Indian-origin person to declare that they are a citizen of India by birth/descent/registration/naturalization and they have neither acquired the citizenship of another country nor have surrendered their citizenship of India.

There are several other declarations that you need to make on this Annexure including but not limited to the security threats, criminal proceedings, and that you were not sent back (deported) from any foreign country at the Indian government’s expense.

Annexure E Online

You can create the Indian Embassy’s Annexure E affidavit easily using AM22Tech’s app.

Open App in new Window

The service offers a full refund if the affidavit is denied by the Indian embassy.

Indian Citizenship type

Annexure E asks for your Indian citizenship type or you can say ‘How you received Indian citizenship’. There are 4 options:

  1. Birth – you were born in India and hence became an Indian citizen.
  2. Descent – means you were born in an Indian family.
  3. Naturalization – means you applied for Indian citizenship through the official citizenship process with the Indian government and they approved it.
  4. Registration – means that the Indian government gave you citizenship through a specific registration process.

You should write the correct option as to how you received your citizenship.

Multiple country citizenships

You should declare about holding multiple country citizenships. Your passport renewal may not approved if you declare wrong information or try to hide information.

India does not allow dual citizenship for its citizens.

For example, if you have received citizenship of the USA, Canada, or any other country, then you are required to surrender your Indian passport and its citizenship to the Indian embassy.

For Indian-origin people, you can apply for an OCI card to visit India without an Indian visa. Please note that you will need an Affidavit of an additional particular form to apply OCI card.

FAQ

Which date should I write for ‘date started living outside India’?

You can write the actual real date when you moved abroad.

Example:
You left India on 1 Jan 2020 to study in the USA. You traveled back to India temporarily for 2 months to spend with family from 1 April 2021 to 30 May 2021. You then returned to the USA to continue your studies.

You should write the date of leaving India as 1 Jan 2020.

Note that if you have changed the address while staying abroad, this date should be the date you started living at your current residential address.

What should I write in Spouse Name on Annexure E If I am not married?

You can either leave your spouse’s name blank or write ‘N/A’ in the space next to your spouse’s name if you are not married at the time of applying for passport renewal.

If you are currently divorced or single, you can leave it blank or write ‘N/A’.
If you remarried after being divorced and are currently married, you should write your current spouse’s name.

Is an Indian address required on Annexure E?

You should write the current non-Indian residential address on the Annexure E form.

What is Moral Turpitude court case on Annexure E?

Moral turpitude is a crime like terrorism, theft, robbery, trafficking, kidnapping, etc.

If you have committed any such crime, you need to provide details like the Court name, offense, and prison/jail time if the judge convicted you.

Why is there a question about Deportation in Annexure E?

Indian embassy wants to know if you were ever deported at the expense of the Government of India.

You should have reimbursed the money back to the government if they paid for your deportation.

Annexure asks about Indian warrants and Summons.

Indian Annexure E has a declaration for pending Indian court summons or warrants against you. If you have any pending, then you should declare it here.
